RALLY BETA / LEGAL
Rally copyright policy
Rally is a shared music studio that Jack Vorwald ("we") runs for a small group of invited people. We respect copyright and expect everyone who uses Rally to do the same. This page explains how to tell us that something in Rally infringes your copyright, what we do when you do, and how the person who added it can respond. It follows the notice and takedown process of the US Digital Millennium Copyright Act (17 U.S.C. 512).
Our designated agent
Send copyright notices and counter-notices to our designated agent:
- Name: Rally Copyright Agent
- Mailing address: Rally, 991 Providence Hwy #1062, Norwood, MA 02062
- Phone: 508-794-5612
- Email: jaqstudioshq@gmail.com
Our agent is also listed in the US Copyright Office's directory of designated agents. Please use this contact only for copyright matters.
Sending a notice
Your notice must be in writing and include all of the following:
- Your physical or electronic signature, as the copyright owner or as someone authorized to act for the owner.
- The copyrighted work you believe is infringed. If one notice covers several works, a representative list is enough.
- The material in Rally you believe infringes, with enough detail for us to find it, for example the project's link and the name of the sound.
- Your name, mailing address, phone number and, if you have one, email address.
- A statement that you believe in good faith that the use is not authorized by the copyright owner, its agent or the law.
- A statement that the information in your notice is accurate and, under penalty of perjury, that you are the owner or are authorized to act for the owner.
Before you send a notice, please consider whether the use could be fair use or otherwise allowed. If you knowingly misrepresent that material is infringing, you may be liable for damages, including costs and attorneys' fees (17 U.S.C. 512(f)).
What we do when we receive a notice
If your notice includes everything above:
- We make the sound unavailable to everyone in its project, usually within two business days. The rest of the project keeps working, and the sound's files are kept unchanged while the matter is open.
- We tell the person who added the sound, with a copy of your notice and an explanation of how to send a counter-notice.
- We keep a record of the notice and of what we did.
If your notice is missing something, we will ask you for it. We do not decide who owns the music; that is between you and the person who added it.
Sending a counter-notice
If a sound you added was made unavailable and you believe this happened by mistake or because the material was misidentified, you can send our agent a counter-notice. It must be in writing and include all of the following:
- Your physical or electronic signature.
- The sound that was made unavailable and where it was before, for example the project and the sound's name.
- A statement, under penalty of perjury, that you believe in good faith that the sound was made unavailable as a result of a mistake or misidentification.
- Your name, mailing address and phone number.
- A statement that you consent to the jurisdiction of the federal district court for the judicial district of your address (or, if your address is outside the United States, any judicial district in which we may be found), and that you will accept service of process from the person who sent the notice or their agent.
We send a copy of your counter-notice to the person who sent the notice. Unless they tell us that they have filed a court action to stop the infringement, we make the sound available again 10 to 14 business days after we receive your counter-notice. We cannot advise you on whether to send one. If you knowingly misrepresent that material was made unavailable by mistake, you may be liable for damages (17 U.S.C. 512(f)).
Repeat infringers
We end the access of anyone whose uploads draw three valid notices within any 12 months.
- A notice counts once, however many sounds it names.
- A notice that was withdrawn, or whose sound was made available again after a counter-notice, does not count.
- We may act sooner for deliberate or large-scale infringement, and we may decline to count a notice we believe was mistaken or abusive.
- Ending access means removing the person from Rally and from every project they belong to. They will not be invited again.
